What Is an Admissibility Hearing?
An admissibility hearing is a proceeding before the Immigration Division of the Immigration and Refugee Board of Canada.
It takes place when CBSA or IRCC asks the Immigration Division to decide whether a person is inadmissible to Canada or removable under the Immigration and Refugee Protection Act. The IRB explains that these hearings are held when there is an allegation that a person does not have the right to be in Canada.
How the Process Works
These hearings are not informal meetings. They are legal proceedings before an independent decision maker.
Minister’s counsel, acting for CBSA or IRCC, presents the case that the person is inadmissible. The person concerned then has the opportunity to respond, present evidence, call witnesses where appropriate, and make submissions. An Immigration Division member decides the outcome.
