Humanitarian and Compassionate (H&C) Applications are a special pathway for people already in Canada who cannot apply for Permanent Residence through the regular immigration streams. These applications are reserved for exceptional cases and are considered on the basis of hardship, fairness, and compassion.

Who Can Apply for H&C?

Eligibility depends on a wide range of personal circumstances, such as:

Family connections and establishment in Canada
Employment history and contributions to the community
Education or volunteer work
Language skills and integration into Canadian society
Financial stability and social connections
The best interests of any children involved

Application Process

Applicants must show that they would face undue hardship or adverse conditions if required to leave Canada. The application process includes:

Preparing a detailed application package from inside Canada.
Submitting a personal statement/letter explaining why H&C consideration is justified.
Providing strong supporting documentation to highlight ties to Canada and risks of removal.

Restrictions & Exceptions

Individuals with failed Refugee Claims may be barred from applying for H&C for 12 months, unless an exception applies (e.g., risk to life, risk of cruel treatment, or best interests of a child).
Certain inadmissibilities cannot be overcome by H&C, such as serious criminality or security grounds.
