When a person is detained by the Canada Border Services Agency, they have the right to an independent review before the Immigration Division of the Immigration and Refugee Board of Canada. The purpose of that review is to decide whether the person should remain in detention or be released.

What Is a Detention Review?
A detention review is a hearing before the Immigration Division.

These hearings are legal proceedings, and the outcome can have immediate and serious consequences.

At a detention review, the Immigration Division examines whether there is a legal reason for detention to continue.
Depending on the case, issues may include identity, danger to the public, likelihood of appearance for immigration proceedings, or other statutory grounds under the law.
