Guidance for Post-Decision Options

Clear Direction After a Serious Decision

A negative decision in a refugee or protection matter can feel overwhelming, but it does not always mean that every option has been exhausted.

What happens next depends on the type of decision received, the reasons for that decision, and the deadlines that apply. In many situations, the most important step is to act quickly and understand what options may still be available.

At Salvera Immigration, we understand how stressful this stage can be. Our role is to help you review the decision carefully, understand the possible next steps, and move forward with clearer direction.

What a Negative Decision May Mean

Not every refusal leads to the same process.

Some individuals may have the right to appeal. Others may need to consider a different form of review or another protection-related pathway. The proper next step depends on the facts of the case, the type of proceeding, and whether the person is legally eligible for that remedy.

Possible Post-Decision Options

Depending on the circumstances, post-decision options may include:

  • an appeal to the Refugee Appeal Division, where available

  • an application to the Federal Court for judicial review

  • a pre-removal risk assessment, if CBSA later confirms eligibility

  • other immigration or humanitarian options, depending on the case

These pathways are not automatic, and not every option is available in every matter. The next step should be assessed carefully and without delay.

Why Acting Quickly Matters

Post-decision matters are often time sensitive.

Appeal rights, deadlines, and eligibility for other remedies can depend on the exact decision received and the date it was issued. The IRB’s refugee claim process guidance says that if a claim is rejected, the person can appeal within 15 days, which shows how quickly the timeline can begin to run.

Early review can make an important difference in understanding what options remain open.
